Our Process
1. Initial Consultation
The first meeting with your lawyer is as much an interview as it is a consultation. It is important that we are all comfortable working with each other and have confidence beginning a new lawyer-client relationship. This is why we prefer we meet in person as opposed to having a discussion over the telephone or by email. Should you be unable to meet, however, we will happily arrange for a telephone or meeting by online video conference. During our meeting, we will review your matter as well as discuss the different ways we can move forward.
There is a small fee for our initial consultation. This fee is discounted from my regular hourly rate. While many lawyers offer a free consultation, a fee allows us to develop a professional working relationship from the first time we meet. We will discuss legal fees should we both determine the services of a lawyer is required, however the meeting is not designed to be a sales pitch. We will also be honest about whether you even require a lawyer as there are often cases where someone with a legal issue can easily deal with the matter without the services of a lawyer.
Before our meeting please take a few moments to write down the facts behind the matter as well as any questions you may have. Since the facts behind a case are so important, it is best to take notes when they are fresh in your mind to ensure nothing is missed when we meet. A detail that may seem of minimal importance to you may be highly significant to the case, so it’s best to write down everything you can remember. During our meeting we ask questions to help fill in anything you may have missed.
If your matter is of a criminal nature and you have already been provided disclosure by the Crown, please bring it along.
2. Preparation Process
Often it can take several months for a legal matter to work its way through the courts. Much of this process may be administrative and will not require us to make any decisions on how to proceed with your case. During this process we would be happy to communicate by telephone or email so you have a full understanding of what is happening with your matter.
Should it be necessary to make any decisions then we will discuss the options together and make the decision that is best for your matter.
During the preparation stage, we will be engaged in meetings with various stakeholders’ involved in your matter. As required, we will discuss strategies for these meetings and the best way they can be utilized to ensure the best possible result in your matter. Additionally, it may be necessary to prepare different types of applications to be served on the court/tribunal and other involved parties’ prior to your trial or hearing.
Should your matter proceed to trial, we will meet 2-3 weeks before the trial to discuss the evidence as well as decide on the best strategy for the trial. In the event we anticipate a need for you to give evidence, we will thoroughly prepare you for this process.
3. Trial or Hearing Support
Should your matter proceed to trial or hearing, we will have made myself available to be present and focus on your matter on the scheduled day. I will endeavour to explain the entire process and the results of various things that may occur. Any decisions will be made together and with your best legal interests in mind.
